Terms and Conditions of MyChart Usage (Terms and Conditions)

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING MYCHART. YOUR USE OF MYCHART CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, THEN DO NOT USE MYCHART.

Purpose and Terms of Use

Phelps Health, including its affiliates Phelps Health Medical Group and Phelps Health Homecare (all of which are referred to herein as “Phelps Health”), is pleased to provide patients with a secure internet-based environment for accessing selected portions of their confidential medical records, such as basic laboratory results, immunization records, and visit histories. This online environment is called MyChart. To request a MyChart account, please apply and enroll by visiting https://mychart.phelpshealth.org/MyChart/accesscheck.asp. Medical information released to MyChart is at the discretion of Phelps Health and your provider(s). You may access MyChart online or with the Epic MyChart Mobile application. Epic MyChart Mobile is currently available for Apple and Android devices.

It is important for you to know how we handle information via MyChart. This Terms and Conditions statement outlines our practices and our sensitivity to your privacy. You agree to use MyChart appropriately and as intended. You may not communicate with providers or staff in an unlawful, threatening, defamatory, obscene, or abusive manner. We reserve the absolute right to revoke access at any time for any reason. The Epic MyChart Mobile application is intended for use on a mobile device that is running an unmodified manufacturer-approved operating system. Modifying the mobile operating system (known as “Jailbreaking”) may undermine the security features intended to protect your medical information from unauthorized or unintended disclosure. Accessing your MyChart account on a mobile device with a modified operating system is a material breach of these Terms and Conditions.

The medical information provided on MyChart is not a replacement for proper medical attention or advice. The electronic record is property of Phelps Health and the information displayed in MyChart is not the complete medical record.

You can choose to stop participating in MyChart at any time by contacting your provider’s office and making a request for your MyChart account to be closed.

Medical Information

By using MyChart, you authorize us to release medical information to you via MyChart. We may be prohibited by law from releasing certain information via MyChart, even though you may consent.

Information on MyChart is provided “as is” without warranty of any kind and is meant for use only to support the patient’s relationship with current or future medical professionals. Your reliance on the material in MyChart is at your own risk. Please note the medical information provided on MyChart is not a replacement for proper medical attention. Contact your provider or 911 services immediately if you are experiencing urgent medical issues.

Access, Correction, and Data Integrity

We will attempt to maintain the accuracy of information on MyChart, but we make no guarantees as to its completeness, or accuracy. If you believe the information found on MyChart is inaccurate, please contact us at (573) 458-7550 or mychart@phelpshealth.org.

Response to Electronic Communication

We will use best efforts to provide a timely response to electronic inquiries. In some cases, staff may not be immediately available, so you should allow at least three (3) business days for a response. Emergency situations requiring immediate attention should never be submitted electronically. You should call 911 or visit the nearest hospital.

Furthermore, with respect to any electronic communications you send, we can only respond based on the information provided by you. If there is insufficient information provided in your communications, we will be prevented from providing accurate and timely services.

E-mail Privacy

As a user of MyChart, you should be aware that you will be notified via e-mail when there is new medical information to be viewed on MyChart. This means any person with access to your e-mail account may see such notifications, including a family member or employer. Although no private medical information will be sent, the notification that new medical information is available in MyChart may be information you do not want others to know. Thus, you should take this into consideration when providing an e-mail address for your MyChart account.

If you send us an e-mail communication, it may be shared with staff who assist in your care. Your confidential medical information on MyChart will be accessible only to appropriate clinical staff on a need-to-know basis. Other than Proxy access, all communication through MyChart should be in regard to your health condition and not in regard to the health of other people. All communications through MyChart may be saved as a permanent part of the your medical record. We are not responsible for any third party’s use of medical information or services through a user’s MyChart account.

Web Site Links

MyChart may offer links to related medical websites that we do not manage. These links are for informational purposes only. We do not endorse and have not verified the accuracy of the information in/on these sites, and you should not rely on any of the information found on these sites for purposes of treatment or diagnosis.

Security and Confidentiality

We afford the same confidentiality to medical information on MyChart as for medical information stored in any other medium. We are committed to protecting the confidentiality of your medical information. We limit employee access based upon roles for your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We can identify the records released and note the time and date of access each time you access MyChart. We have taken steps to make MyChart information secure against unauthorized access and use.

For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4). You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This indicates your medical information cannot be read or deciphered by unauthorized individuals.

User names and passwords provide two layers of authentication and are stored in an encrypted database isolated from the internet. As a MyChart user, your role in maintaining the security of your medical information includes (i) changing your password on a regular basis, and (ii) keeping your login ID and password confidential. We are not responsible for someone breaching your medical information if you shared your login ID or password with another person.

MyChart may not be available at all times due to system maintenance or other causes beyond our control. Access is provided on an “as-is, as-available” basis and we do not guarantee you will be able to use MyChart at any particular time. During times when MyChart is unavailable, other communication methods (e.g., telephone, in-person visits) should be used to access your health care providers. MyChart is provided for your convenience and its availability is not an entitlement or right.

Your activities within MyChart may be tracked by computer audit and entries you make may become part of the medical record. You are solely responsible for any action taken in confidence on any entries you make in MyChart and/or the medical record.

Proxy Access

Proxy access allows a patient to grant MyChart access to others. Individuals age 18 or older may request proxy access to a patient’s MyChart account by completing the MyChart Proxy Application and submitting it as instructed. Phelps Health will only grant proxy access to the MyChart medical information of a patient over the age of 18 (adult patient) upon valid authorization and written consent by that patient via the MyChart Adult Proxy HIPAA Authorization. Proxy access to a patient under the age of 18 (minor patient) will only be granted to parties with parental rights and/or legal guardianship over the MyChart account holder, subject to conditions set forth in these Terms and Conditions. Parental or guardianship access will be granted only to the extent that the party requesting proxy access can demonstrate the legal right to account holder’s medical information and within the parameters described herein, in accordance with legal restrictions. Except for parents, only one person will be granted proxy access to a MyChart account. A MyChart account will be activated for both the proxy holder and the account holder. If the proxy holder’s legal relationship with the account holder changes, then the patient and/or the proxy holder must inform Phelps Health immediately. Adult proxy access will automatically expire annually, requiring a repeat of the proxy request process.

Minor Eligibility

An individual must be age 13 or older to independently request a Phelps Health MyChart account without parental or guardian consent. Parents or guardians of minor children (ages up to 18) may request access to such a minor child’s account as explained in the “Proxy Access” section of this Terms and Conditions statement. However, the full spectrum of MyChart services may not be available for the records of minor ages 13 to 17. Under the law, there are types of medical information the parent or guardian of a minor patient may not view without consent of the minor patient. Because of these requirements, we cannot offer the full spectrum of services to parents of minor patients in this age category. Thus, when a minor patient reaches age 13, the patient must request a new account and restrictions will be placed on MyChart access until he/she reaches age 18. Any parental access will terminate once a child reaches the age of 18.

Text Messaging (SMS) Terms and Conditions and Privacy Policies

Phelps Health MyChart Text Messaging

Program Description: Phelps Health MyChart Text Messaging allows mobile subscribers to opt-in to receive information from Phelps Health through SMS messages straight to the subscriber's phone.

Supported Carriers: Phelps Health MyChart Text Messaging is available on the following carriers: AT&T, Boost Mobile, Cricket, Sprint PCS, T-Mobile, U.S. Cellular, Verizon Wireless, Virgin Mobile USA, and.

Cost: There are no premium charges for joining Phelps Health MyChart Text Messaging, or for receiving the alert. However, message and data rates may apply.

Message Frequency: If you opt-in to receive alerts from Phelps Health, you will receive a text message when new information is viewable in your MyChart account (e.g., new test results, appointment reminders, message from your doctor, etc.).

Privacy

  • Phelps Health will never, under any circumstances, sell or distribute your mobile number to third parties without your consent.
  • Phelps Health will never directly market to you any services without your consent.
  • Phelps Health will never distribute any personal information about you.

Suspension/Deactivation

Your ability to access or use MyChart (and that of your proxy(ies)) may be suspended or deactivated at any time, at our discretion. Following is a list of reasons that may result in suspension/deactivation, and this not exhaustive:

  1. Automatic system deactivation will occur after a number of failed login attempts to access the secure portion of the MyChart system.
  2. Inappropriate use of messaging or scheduling
  3. Violation of security standards or any provision of these Terms and Conditions
  4. Inability to use features without repetitive or continued assistance
  5. To protect you or your information from suspicious activity or other known or suspected security concerns
  6. To protect others or others’ information from suspicious activity or other known or suspected security concerns
  7. To protect our systems or information from suspicious activity or other known or suspected security concerns

Use of Information

Phelps Health may track users’ requests, inquiries, and traffic patterns.

While you are logged into MyChart, we will log your IP address (a number assigned to your computer when you use the internet), your browser type and platform, access times, and other access and use data to track and audit usage patterns, security parameters, and other metrics.

Phelps Health may monitor your activity while you are reviewing and using MyChart. This information may include or track personal information.

Cookies

To facilitate MyChart navigation, improve functionality, and enhance your MyChart experience, we may collect information through “cookies” and by tracking certain technical information about your computer, which may include elements such as location, operating system, browser type, MyChart entry and exit points, and travel through MyChart. Cookies are small strings of text sent by MyChart to your browser and then stored by your browser on your computer’s hard drive. We use cookies to help diagnose problems with our system and administer MyChart. We also use cookies to help identify you in respect to visits to MyChart, and to determine whether you visited MyChart from a particular internet link. Most web browsers automatically accept cookies, but it is possible to change your browser settings to not accept cookies. However, rejecting cookies may prevent you from taking advantage of certain portions of MyChart.

LIMITATIONS OF LIABILITY

We assume no responsibility and will not be held liable, for any damages to, or any viruses that may infect, your computer, telecommunication equipment, or other property caused by or arising from your access to, use of MyChart, or any information or materials you download from MyChart. IN NO EVENT WILL PHELPS HEALTH OR ANY OF ITS OFFICERS, TRUSTEES, EMPLOYEES, AFFILIATES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF MYCHART OR THE MATERIALS, INFORMATION OR SERVICES CONTAINED ON ANY SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Governing Law

This Agreement and its performance shall be governed by the laws of the state of Missouri without regard to its conflict of law provisions. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in and/or for Phelps County, the State of Missouri, in all questions and controversies arising out of your use of the MyChart services.

Severability and Waiver

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions contained herein, which shall remain in full force and effect. No waiver of any provision of these Terms and Conditions shall be deemed a continuing waiver of such term or condition or any other term or condition.

Revisions to these Terms and Conditions

These Terms and Conditions may be revised at any time and from time to time by updating this posting. You should visit this page from time to time to review the then current Terms and Conditions because they are binding on you. Certain provisions of these Terms and Conditions may be superseded by legal notices.
